Proof of Consent and Its Knowledge in the Law of Sexual Offences Project: Meeting of the Co-Reporters and Advisory Committee Members

Proof of Consent and Its Knowledge in the Law of Sexual Offences Project: Meeting of the Co-Reporters and Advisory Committee Members

On 15 June 2026, the Reporters and AC members met online to discuss the draft guidelines.

The project, headed by Mrs Justice Bobbie Cheema-Grubb DBE and Prof Dr Martino Mona, aims to produce guidance that is practical for prosecutors and investigators. The draft guidelines were developed on the basis of responses provided by Advisory Committee members to the scenarios prepared by the Reporters. A total of nine responses were received, covering Switzerland, Canada, France, Belgium, England and Wales, Sweden, Spain, and the Netherlands.

On the basis of the feedback received, the Reporters will continue drafting the Principles with a view to finalising the output by December 2026.

More information on the project is available here .
